Legal stuff.

Here's all that user agreement, privacy, copyright, trademark, and other legal stuff that you just can't wait to read.

1 Introduction

Effective: November 21, 2014.

Your access to and use of our websites, associated information, and other activities (the 'Service') is subject to the terms herein (the 'Agreement').

By using the Service you acknowledge you've read, understand and accept this Agreement. If you don't agree, don't use the Service.

2 Provision of Service.

We don't guarantee continuous, uninterrupted or secure access to the Service.

We can at any time without notice temporarily or permanently amend, change, restrict or remove the Service in whole in part, for any or all users.

3 Acceptable use.

You represent that you're of legal age to form a binding contract and aren't barred from receiving it under law or other applicable jurisdiction.

You can't use the Service in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You can use (including view, download and print) the Service for your own personal, non-commercial use.

You're fully responsible for any information you send to us, and agree to provide true, accurate, current and complete information about yourself when registering, contacting us, or otherwise sending information in connection with your use of the Service.

You can't send information that is deceptive, misrepresentative, untruthful, offensive, indecent, obscene, threatening, abusive, harmful, defamatory, libelous, invasive of another's privacy, encourages others to violate this Agreement, or is otherwise objectionable, in bad faith or inappropriate; nor which you don't have a right to make available, or which infringes any proprietary rights, violates this Agreement, or any applicable local, national or international law or regulation.

You can't access or tamper with any non-public part of the Service or storage/delivery systems, attempt to circumvent our security or authentication measures, access the Service in any way that causes or is likely to cause damage to or impairment of the availability or accessibility of the Service.

You're responsible for maintaining the confidentiality of any user id/password information we issue to you, and all activities that occur through your use of it. You won't reveal it (or cause to be revealed through any act or omission) to any other person or organisation, and will immediately notify us of any unauthorized use or other breach. We're not and won't be liable for any loss or damage arising from your failure to comply with this.

4 User-submitted content.

When sending information clearly intended for public viewing, and for other information for which we have obtained your consent to publish, you retain the copyright and appropriate other rights; and grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive licence to display, publish, transmit, transfer, distribute, copy, modify, adapt and otherwise use that information in whole or part and to use your name and other identifying information you provide in connection with that information.

You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to any information you submit.

We've no responsibility or liability for the storage or deletion of such information.

5 Privacy.

Our Privacy policy is an integral part of this Agreement.

6 Proprietary rights.

The Service contains proprietary material owned by ourselves and/or appropriate others, protected by applicable laws.

Except as permitted by law or 'reasonable sharing' of insubstantial parts for non-commercial purpose, or consented to by us and/or appropriate others by additional agreement, you can't copy, modify, make available or distribute it or derivative works based on the Service in whole or in part, or exploit for any commercial purpose any part of the Service.

All rights not expressly granted herein are hereby reserved.

7 Limited warranties and exclusions of liability.

The Service is provided 'as is' and on an 'as available' basis. You use it at your own discretion and risk; we're not responsible for your use and any consequences thereof.

The Service may contain information submitted by users and links to other resources and services. All such information is the sole responsibility of the person or organisation from whom it originated and we don't endorse, support, or guarantee the completeness, truthfulness, accuracy, suitability, reliability or legality of such information and you've sole responsibility for and assume all risk arising from your use of it.

We can remove or amend information we consider inappropriate, and restrict use by persons and organisations, but aren't so obligated or liable for any consequence thereof or failure to do so.

To the maximum extent permitted by applicable law we disclaim any representations or warranties, express or implied, including but not limited to, completeness, accuracy, availability, timeliness, security, reliability, merchantability, fitness for purpose, non-infringement of the Service.

We're not and won't be liable to you or any other person or organisation for any direct or indirect loss, damage, harm, injury or consequence (including without limitation, loss of profits, data, good-will, or other intangible losses) of any nature and howsoever caused (including any defamatory, offensive, illegal or other conduct of any other user, person or organisation) arising from your use of or inability to use the Service.

No advice or information, whether oral or written, obtained from us or through the Service, will create any warranty not expressly made herein.

8 Indemnity.

You indemnify us and undertake to keep us indemnified against any actions, claims, losses, damages, harm, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers) incurred or suffered by you or us as a direct or indirect consequence of your using the Service or arising out of any breach by you of this Agreement or claim that you have breached this Agreement.

9 Exclusion of third party rights.

This Agreement is not intended to benefit any third party or be enforceable by any third party. The exercise of our and your rights in relation to this Agreement is not subject to the consent of any third party.

10 Entire agreement.

Except where there is a separate agreement, this is the entire agreement between you and us regarding the Service and supersedes all previous agreements.

11 Breach.

If you breach or we consider you've breached this Agreement, or we believe that you've violated or acted inconsistently with the letter or spirit of it, or we're unable to verify or authenticate any information you provide to us, or we believe your actions may cause legal liability for you, us, other users persons or organisations, we can without prior notice take any action we deem appropriate, including suspending or terminating your access to the Service and commencing legal proceedings.

12 No waiver.

Any failure by us to enforce any provision of this Agreement won't be deemed a waiver of our right to subsequently enforce such or any other provision.

13 Assignment.

We can without prior notice or your consent transfer, sub-contract or otherwise deal with our rights and obligations under this Agreement.

You can't transfer, sub-contract or otherwise deal with your rights and obligations under this Agreement and conditions.

14 Severability.

If any provision of this Agreement is invalid or unenforceable under applicable law, the remaining provisions will remain in full force and effect and the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.

15 Law and jurisdiction.

This Agreement is construed in accordance with and shall be governed by English law. Disputes relating to it shall be subject to the exclusive jurisdiction of the English courts.

16 Variation.

We can amend this Agreement at any time and without prior notice. The revised Agreement will be effective immediately upon publication onsite at this url. By continuing to use the Service after such amendment you agree to be bound by the then current Agreement.

17 Our details.

The Service is operated and provided by Honk Radio, 24 Heron Way, TQ2 7SW, England.

18 Titles.

The section titles in this Agreement are for convenience only and have no legal or contractual effect.
